sticky traffic situation

so i ran into an unusual situation the other day and got pulled over. imagine driving down a perfectly straight flat section of U.S. highway. come up behind someone doing 5 under the speed limit. your in a legal passing zone so you signal excelerate, and pull into the oncomming lane. halfway around the vehicle a truck aproaches an intersection ahead of you on your left. he stops looks left, then turns directly into your path. he quickly pulls of onto the shoulder to avoid the accident. but in the mean time blue lights have come on in your rearview.

so i get pulled over and the question is who was in the wrong, and wether i got a ticket or not?
so ill let you know after i get some input.

I say D.O.T. is in the wrong. What mental giant allowed a passing zone through an intersection?!?!?!?!?

I agree with Dave--however seeing how DOT will not get blamed you pulled into "oncoming traffic", ooops is that how you worded it? To pass a vehicle you would have accelerated and gone over the the speed limit--you received a ticket for illegal passing through an intersection, wrecKless endangerment, speeding, and failure to exercise due caution. Don't you know to use your brakes and drive like a little old lady when Smokey is right behind you? :empathy:

even worse it was in the upper penninsula of michigan.



ps. i didnt go over the speed limit, and there wasn't any oncomming traffic when i started to pass.

ok i was hoping to hear some law guys chime in. but here it goes. upon discussing the situation with the officer. i pointed out that the other guy had the responsibility to stop for all traffic and not just traffic comming from his left. that he had no right to pull out. sooo i get out scott free. yeah :2thumup:
